TERMS AND CONDITIONS OF USE

Riverside Medical Clinic is pleased to offer you member information via a Web-based version of our computer systems called My Healthy Connection.

To request an account, submit a My Healthy Connection Consent Form to the Riverside Medical Clinic Medical Records department, indicating you have read this Terms & Conditions Statement.

We think it is important for you to know how we handle information we communicate via the Internet. This Terms & Conditions statement outlines our practices and our sensitivity to your right to privacy. We reserve the right to revoke access at any time for any reason.

My Healthy Connection Portal will offer the following Services:

* Ability to review, make or cancel appointments

* Ability to review selected portions of your medical record such as allergies & medications

* Ability to receive selected lab results as allowed by California law (H&S Code §123148)

* Communicate with your physician via secure messaging regarding health concerns

* Request prescription refills

* Links to other sites that will provide you health information

Personal Identification Code and Password – I understand that I will be given a unique access code by Riverside Medical Clinic to allow me access to My Healthy Connection. The first time I log into My Healthy Connection I will be required to create a unique six character User ID and a six-character password. I agree to keep my user ID and password confidential. Anyone with access to my user ID and password would have access to my personal health information, ability to add to my personal health information and message my providers as if they are me. It is my responsibility to change my password if I believe it has been compromised or shared with someone else. It is recommended that you change your password every 180 days. Every time I log into My Healthy Connection, my user ID and password will be logged in an audit trail in the computer system.

I understand that if Riverside Medical Clinic discovers that I have inappropriately shared my password or that I have abused my access privileges, Riverside Medical Clinic may terminate my participation in My Healthy Connection. I understand that Riverside Medical Clinic takes no responsibility for and disclaims any and all liability for damages arising from a breach of medical record confidentiality resulting from my sharing or losing my password.

Response to Electronic Communication – Riverside Medical Clinic will make its best effort to provide a timely response to electronic inquiries. In some cases, the clinic staff that needs to respond to an electronic inquiry or other communication may not be immediately available so a patient should allow at least two (2) business days for a response. Accordingly, emergency situations requiring immediate attention should not be submitted electronically.

Furthermore, with respect to any electronic communications sent by the patient, we are only able to respond to such communications based on the information provided by the patient. If there is insufficient information provided, we will be unable to provide accurate and reliable services.

Availability – My Healthy Connection may not always be available due to system maintenance, back-ups or failures. Access is provided on an “as is available” basis and is not guaranteed at any particular time.

Web Site Links - My Healthy Connection may offer links to related medical Web sites not managed by Riverside Medical Clinic. These Web site link(s) are for a patient’s informational purposes only. Riverside Medical Clinic does not endorse and has not verified the accuracy of the information in/on these Web sites, and the patient should not rely on any of the information found on the Web sites for purposes of treatment or diagnosis.

Minor Eligibility - An individual must be age 18 or older to request a personal account. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section of this Terms and Conditions statement. Minor children between the ages of 12 and 17 (inclusive) will not be eligible to participate in My Healthy Connection services. Under State and Federal law, there are certain types of medical information that the parent or guardian of a minor patient age 12 or older may not view without consent of the minor patient. Because of these requirements, we cannot offer services to parents of minor patients in this age category. Thus, when a minor patient reaches age 12, access will be revoked to My Healthy Connection until he/she reaches age 18.

Proxy Access - A parent or legal guardian of a minor child up to the child’s 12th birthday or individuals age 18 or older may request proxy access to another individual’s My Healthy Connection account by completing the Proxy Access portion of the My Healthy Connection Consent Form and submitting it to Riverside Medical Clinic. Such access will only be granted to parties with parental rights or legal guardianship over the My Healthy Connection account holder and only to the extent that the party requesting proxy access can demonstrate the legal right to account holder's medical information. Only one person will be granted proxy access to a My Healthy Connection account. A My Healthy Connection account will be activated for both the proxy and the account holder. If the proxy’s legal relationship with the account holder changes, the proxy must inform the clinic immediately by calling Riverside Medical Clinic Medical Records Department at 782-3733, or sending written notice to Riverside Medical Clinic, Medical Records Department, 3660 Arlington Ave, Riverside, CA 92506. Riverside Medical Clinic reserves the right to revoke proxy access at any time for any reason.

E-mail Privacy - Patients who are users of My Healthy Connection should be aware that they will be notified via e-mail when there is new medical information to be viewed on My Healthy Connection. This means that any person with access to a patient’s e-mail will be able to see this notification. This could include the patient’s spouse, employer or anyone else that can access a patient’s e-mail account. Although no private medical information will be sent, the notification that new medical information is available by accessing My Healthy Connection may be information that a patient would not want others to know. Thus, patients should take this into account when providing an e-mail address.

Please know that if you send us an e-mail communication, it becomes part of the medical record and may be shared with the Riverside Medical Clinic staff that assists the physician in providing the patient’s medical care. A patient’s confidential medical information on My Healthy Connection will be accessible only to appropriate clinical staff. The e-mails, as part of the medical record, may also be shared with your health plan for billing purposes without separate consent.

Security and Confidentiality - We afford the same degree of confidentiality to medical information stored on My Healthy Connection as is given to medical information stored by Riverside Medical Clinic in any other medium. Riverside Medical Clinic is committed to protecting the confidentiality of your medical information. We limit Riverside Medical Clinic employees’ access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time a patient accesses My Healthy Connection. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use.

For other than general information viewing, My Healthy Connection must be accessed with a Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer versions 5.0 or greater). Our SSL web server uses authentication and offers the highest level of encryption technology commercially available (128-bit RC4).

You can tell when you are secure by looking at the location (URL) field. If the URL begins with https:// (instead of http://), the document comes from a secure server. This means your data cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly connected to Riverside Medical Clinic by viewing the digital certificate. This certificate verifies the connection between the Riverside Medical Clinic server's public key and the server's identification.
